Welcome to LexiPrompt.pro (the "Service"), operated by LexiPrompt ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

1. Acceptance of Terms

By creating an account, using the Service, or clicking "accept" or "agree" to these Terms when prompted, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference.

2. User Accounts

To access certain features of the Service, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account.

3. User-Generated Content

You may be able to create, post, or share content, such as text prompts or images ("User Content") using the Service. You retain all rights in, and are solely responsible for, the User Content you post to the Service. You grant us a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service and our business, including for promoting and redistributing part or all of the Service.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Using the Service for any illegal purpose or in violation of any local, state, national, or international law;
Violating, or encouraging others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right;
Posting, uploading, or distributing any User Content or other content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, or otherwise inappropriate;
Interfering with security-related features of the Service, including by disabling or circumventing features that prevent or limit use or copying of any content;
Interfering with the operation of the Service or any user’s enjoyment of the Service, including by uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code.

5. Subscription Terms (Placeholder)

Certain features of the Service may be offered on a subscription basis ("Subscription"). If you purchase a Subscription, you will be billed in advance on a recurring, periodic basis (each period, a "billing cycle"). Billing cycles are typically monthly or annual, depending on what subscription plan you select when purchasing a Subscription.

Your Subscription will automatically renew at the end of each billing cycle unless you cancel it through your account management page, or by contacting us. You may cancel your Subscription renewal either through your online account management page or by contacting LexiPrompt customer support team.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide LexiPrompt with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize LexiPrompt to charge all Subscription fees incurred through your account to any such payment instruments.

(Developer Note: Detailed terms regarding fees, free trials, fee changes, refunds, etc., will need to be added here when subscriptions are implemented.)

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEXIPROMPT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., State of California, USA], without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
